I accept the following terms for my own entry. I also accept the terms on behalf of any other participants I am entering in this event, all of whom have been provided with a copy of these terms and accept them:

I have read and agree to the event rules

I declare that the information on this form is complete and correct. I understand and agree that I participate in this event at my own risk and that I must rely on my own ability in dealing with all hazards.  I am aware that the function of the marshals is only to indicate direction and that I must decide if the movement is safe. I agree that no liability whatsoever shall be attached to the promoter, promoting club, meeting sponsor(s) or member of the promoting club in respect of any injury, loss or damage suffered by me on or by reason of the event, however caused.

I consent to publication of my name, club, race category, race number, finishing time and race position in race pre-entry and results lists.

Waiver: In consideration of being permitted to participate in the Stour Valley Path ultra run, for myself, my agents, attorneys, representatives, affiliates, heirs and assigns, and all persons claiming by, through, for or under me or any of them or on my or any of their behalf, I do hereby release, waive, covenant not to sue and discharge the organiser Matthew Hearne, together with his affiliates and his respective predecessors, successors, and assigns, both jointly and severally, and his current and former officers, directors, employees, agents, representatives, members, shareholders, owners, partners, heirs, executors, and administrators, of and from any and all manner of actions and causes of action, suits, debts, claims, liabilities, and demands whatsoever in law or in equity which I or they ever had, or now have, or may have, or which my heirs, executors, or administrators hereafter may have by reason of any matter, cause, or thing whatsoever (collectively, “Claims”), including but not limited to any and all Claims, arising from or out of, or in any way related to, personal injury, accidents or illnesses (including death), and property loss arising from or out of, or in any way related to, but not limited to, my participation in the Stour Valley Path ultra run. In consideration of the acceptance of this entry, I assume full and complete responsibility for any injury or accident which may occur while I am travelling to or from the event, during the event, or while I am on the premises of the event.
 
Assumption of risks: Participation in ultra marathons carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. I know that running an ultra marathon is a potentially hazardous activity and certify that I am in good health and physically fit to enter into such an event. I acknowledge that I am aware of the many risks involved ultra marathons, which include by way of example and not limitation: 1) minor injuries such as scrapes, bruises, sprains, strains, and stings, 2) more serious injuries such as joint, muscle and bone injuries, concussions and other head injuries, heat-related injuries such as heat stroke and heat exhaustion, dehydration and over-hydration conditions such as hyponatremia, and 3) catastrophic injuries and conditions such as heart attacks and other conditions or injuries which could be fatal. I have read the previous paragraph and I know, understand, and appreciate these and other risks that are inherent in participating in ultra marathon road and trail running and racing, in addition to the potentially adverse effect of weather, traffic, and conditions of the trail and road. I hereby assert that my participation is voluntary and that I knowingly assume all such risks.
 
Indemnification and hold harmless: I agree to INDEMNIFY AND HOLD HARMLESS Matthew Hearne, and the volunteers and event organisers, from and against any and all losses, liabilities, obligations, damages, Claims, judgments, assessments, penalties, costs and expenses, including attorneys’ and other professionals’ fees and disbursements based upon, attributable to, resulting from, or in any way related to, the breach or violation of any agreement, covenant, obligation or other provision set forth herein, or based upon, attributable to, resulting from, or in any way related to, my involvement in the Stour Valley Path ultra run. 
 
Severability: The undersigned further expressly agrees that this Waiver of Liability, Assumption of Risks and Indemnity Agreement is intended to be as broad and inclusive as is permitted English law and that if any portion hereof is held to be invalid by a court of competent jurisdiction, it is agreed that the balance shall, notwithstanding such holding, continue in full legal force and effect. 
 
Media: I hereby grant full permission to Matthew Hearne and the other organisers of the Stour Valley Path ultra run to use any photographs, videotapes, motion pictures, website images, recordings or any other record of this event, which may capture my image, for the purpose of promoting this event and any similar events in the future.
 
Acknowledgement of understanding: I have read this Waiver of Liability, Assumption of Risks, and Indemnity Agreement, fully understand its terms, and I understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this Agreement freely and voluntarily, and intend by my signature for it to be a complete and unconditional release of all liability to the greatest extent allowed by law.

You are also aware of our refund and transfer policy as outlined on our website and outlined as follows:

A 70% refund will be provided any time up until 4 weeks from the date of the race, after which no refunds will be given. This policy is not dependent on circumstances and is final.

We are unable to defer entries to subsequent years and we also do not allow the transfer of places from one runner to another to ensure that everyone has a fair chance to entering.

The only exception to the refund policy outlined above is for pregnancy. Any runner informing us of pregnancy by email at info@svp100.co.uk any time up until 4 weeks from the date of the race will be eligible for a full refund.
